These Terms of Service (“Terms”) govern your access to and use of the Mindfully Mina’s website, online store, products, services, and related features operated by Mindfully Mina’s LLC (“Mindfully Mina’s,” “we,” “us,” or “our”).
Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services to you.
By visiting our website, placing an order, creating an account, subscribing to communications, or otherwise using our website or services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, which are incorporated into these Terms by reference.
If you do not agree with these Terms, please do not use our website or purchase our products.
1. Eligibility
By using our website or placing an order, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.
If you are under the age required to enter into a binding contract where you live, you may use our services only with the involvement and permission of a parent or legal guardian.
You may not use our website or products for any unlawful or unauthorized purpose.
2. Our Products
Mindfully Mina’s sells food products, including protein cookies, refrigerated protein balls, limited-edition products, bundles, and other items that may be offered from time to time.
We make our products in small batches, and product availability may change without notice.
Because our products are handmade, natural variations may occur between batches, including differences in appearance, shape, color, texture, glaze, toppings, or other characteristics. These variations do not necessarily indicate a defect.
Photographs and product images are intended to represent our products as accurately as reasonably possible, but the product you receive may vary slightly from images displayed on our website.
3. Ingredients, Allergens & Dietary Information
We work to provide accurate ingredient, allergen, dietary, and nutrition information for our products.
However, customers are responsible for reviewing the ingredient list, allergen statement, nutrition information, and other product information before purchasing or consuming any product.
Mindfully Mina’s products may contain or be produced around common allergens, including peanuts, tree nuts, sesame, wheat, milk, soy, and eggs, depending on the product and facility environment.
We use certified gluten-free ingredients in products that are described as such and use separate ovens and equipment for our products. However, our products are made in a shared kitchen where gluten is present, and cross-contamination is possible.
We do not represent that our kitchen or products are certified allergen-free or certified gluten-free unless expressly stated otherwise.
If you have a severe food allergy, sensitivity, intolerance, medical dietary restriction, or other concern, please review all product information carefully and contact us before purchasing if you have questions.
4. Nutrition & Wellness Information
Any information provided on our website regarding ingredients, protein content, nutrition, dietary preferences, wellness, or similar topics is provided for general informational purposes.
Our products and website content are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and information on our website is not a substitute for professional medical or nutritional advice.
Individual dietary needs vary. You are responsible for determining whether a product is appropriate for you.
5. Orders
When you place an order, you are making an offer to purchase the products in your cart subject to these Terms.
Receipt of an order confirmation does not necessarily mean that we have accepted or fulfilled the order.
We reserve the right, where reasonably necessary, to refuse, limit, or cancel an order, including in cases involving:

- Pricing or listing errors
- Suspected fraud or unauthorized transactions
- Orders that appear intended for unauthorized resale
- Shipping restrictions

- Circumstances that prevent us from safely or reasonably fulfilling the order
If we cancel an order after payment has been successfully processed, we will refund the applicable amount paid for the canceled items.
6. Product Availability & Quantity Limits
Products are available while supplies last.
Because we produce in small batches, certain products—particularly limited-edition flavors—may sell out quickly.
We may limit quantities available per customer, household, order, or transaction when reasonably necessary to protect product availability or prevent unauthorized resale.
We may discontinue or modify products at any time without prior notice.
7. Prices & Payment
All prices displayed on our U.S. store are stated in U.S. dollars unless otherwise indicated.
Prices, promotions, discounts, product availability, and shipping rates may change without notice.
Applicable taxes and shipping charges will be displayed during checkout when required.
You agree to provide current, complete, and accurate billing and payment information when placing an order.
Payments are processed through Shopify and/or third-party payment providers. We do not independently control those providers’ payment-processing systems.
8. Pricing & Listing Errors
We make reasonable efforts to ensure that product descriptions, prices, promotions, availability, and other information on our website are accurate.
Occasionally, errors may occur.
We reserve the right to correct errors, inaccuracies, or omissions and to update information at any time.
If a material pricing or listing error affects an order you have already placed, we may contact you to provide the option of proceeding under the corrected terms or canceling the affected portion of the order.
Nothing in this section limits any rights you may have under applicable consumer-protection law.
9. Discounts & Promotions
Promotional codes, discounts, free-product offers, sales, and other promotions may be subject to additional terms communicated with the offer.
Unless otherwise stated:
- Promotions cannot be combined.
- Discounts have no cash value.
- Discounts cannot be applied retroactively to previous purchases.
- Expired promotional codes cannot be honored.
- Promotions may exclude certain products or collections.
- We may modify or end a promotion as permitted by law.
If a promotion contains its own terms, those terms govern the promotion.
10. Shipping & Delivery
Shipping terms, rates, schedules, refrigerated-product handling, carrier delays, address responsibilities, and delivery issues are governed by our Shipping Policy.
Cookie-only orders currently ship via UPS Ground Saver throughout the week.
Orders containing refrigerated protein balls are subject to our refrigerated shipping procedures, including our Monday–Wednesday shipping window, UPS Next Day service, and applicable flat refrigerated shipping fee.
Orders placed after the applicable Wednesday cutoff may ship the following Monday.
Carrier transit times are estimates unless expressly stated otherwise.
Once an order has been transferred to the carrier, certain circumstances—including weather, carrier delays, transportation disruptions, and delivery conditions—may be outside of our direct control.
Please review our Shipping Policy before ordering refrigerated products.
11. Refrigerated Products
Protein balls are refrigerated food products.
Customers are responsible for monitoring tracking information, retrieving refrigerated orders promptly after delivery, and following the storage and handling instructions provided with the product and on our website.
Protein balls may soften during transit and gel packs may arrive partially or fully thawed. Minor changes in texture, glaze, appearance, condensation, or positioning may occur during transportation and do not automatically indicate a defective product.
Protein balls should be refrigerated upon arrival and allowed to chill before enjoying for the intended texture.
If you are concerned about the condition of a refrigerated product when it arrives, please follow the reporting instructions in our Shipping Policy and Return Policy.
12. Returns, Refunds & Exchanges
Because we sell food products, we generally do not accept physical returns or exchanges.
Refunds, replacements, and credits are governed by our Return & Refund Policy.
If an order arrives significantly damaged, contains the wrong item, or has another qualifying issue, you must contact us within the reporting period specified in that policy and provide any requested documentation or photographs.
Personal taste preferences, normal handmade variation, or minor transit-related cosmetic changes do not automatically qualify for a refund or replacement.
Nothing in these Terms limits refund, replacement, or cancellation rights that cannot legally be waived.
13. Best By Dates & Product Quality
Any “Best By” date appearing on our products is intended primarily as a quality reference for the period during which we expect the product to provide its best flavor and texture.
A Best By date is not necessarily the same as an expiration date.
Customers are responsible for following applicable storage instructions and using reasonable judgment when consuming food products.
14. Customer Accounts
If customer-account functionality is available, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You agree to provide accurate account information and promptly update information when it changes.
Please contact us if you believe your account has been accessed without authorization.
We may suspend or restrict an account where reasonably necessary to prevent fraud, misuse, security threats, or violations of these Terms.

You may use our website for lawful personal and commercial purchasing purposes consistent with these Terms.
